To Whom It May Concern:

 Pursuant to Delaware's Freedom of Information Act, I hereby request the following records: 

 1)All inventories and certification statements submitted by the Dewey Beach Police Department since January 2014.  This should include serial numbers and photos for all controlled property identified in Paragraph III D of the Memorandum of Agreement between the Defense Logistics Agency and the the State of Delaware signed on June 28, 2016 and certification statements for all controlled property.

 According to Memorandum of Agreement between the Defense Logistics Agency and the the State of Delaware signed on June 28, 2016, all inventories and certification statements are to be maintained on file indefinitely.

 2) The most recent Program Compliance Review for the Dewey Beach Police Department.

 3)All property records for property obtained through the 1033 program by the Dewey Beach Police Department since 2014.

 According to Memorandum of Agreement between the Defense Logistics Agency and the State of Delaware signed on June 28, 2016, “The LESO, State Coordinator, and LEAs enrolled in the LESO Program must maintain all records in  accordance with the DLA Records Schedule. Records for property acquired through the LESO Program have retention controls based on the property's DEMIL Code. All documents concerning a property record must be retained. 

1) Property records for items with DEMIL Code of "A" must be retained for two (2) calendar years from ship date, and then may be destroyed. 

2)Property records for controlled property must be retained for five (5) calendar years or for the life span of the property, whichever is longer. 

3)Environmental Property records must be retained for fifty 50) years, regardless of DEMIL Code (Chemicals, Batteries, Hazardous Material/Hazardous Waste). 

4)LESO Program files must be segregated from all other records. 

5)All property records must be filed, retained and destroyed in accordance with DLA Records Schedule. These records include, but are not limited to the following: DD Form 1348-1 A, requests for transfer, turn-in, or disposal, approved Bureau of Alcohol, Tobacco, Firearms and Explosives(BATFE)Forms 10 and 5, Certificate of Aircraft Registration (AC Form 8050-3), Aircraft Registration Application (AC8050-l) and any other pertinent documentation and/or records associated with the LESO Program.”  

 4)All requests for excess DOD property through the LESO program made by the Dewey Beach Police Department and the justification for each requested excess DOD Property.

 5) All prior to July 26, 2016 signed Defense Logistics Agency (DLA) approved State Plan of Operation(SPO) between Dewey Beach Police Department and the State of Delaware signed by the Chief Executive Officer of the Dewey Beach Police Department.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

  In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

DEMA has no additional documents responsive documents to your request, please refer to Attorney General Opinion No. 17-IB61, also attached.
